    Hello,

    I'm working for company "A" on L1B visa. I applied for H1 this year through company "B" and my case got selected in lottery. He applied with COS.

    My case is still not approved. I'm worried. This starus of the USCIS website shows "Pending".

    I'm planning to do leap frog. Leave US on Sept 10 and return on Oct 10 on L1B visa.

    My questions are:

    a) What if my H1 case does not get approved by Sept 10 and I travel out of US on Sept 10 ? Will my H1 get rejected ?

    b) Will it cause any problems to my L1B visa ?

    c) Will my company A know that I've applied for H1 with COS ?

    I've read the forum but not really confident. Since this is a mater of my visa, I need answers to my questions.

      -- If you travel before approval then COS will be void. H1B wont be rejected (if employer record is good enough)

      b) Will it cause any problems to my L1B visa ?

      -- No, your L1B in trouble only if your case is approved with COS now.

      c) Will my company A know that I've applied for H1 with COS ?

      -- Not unless you tell them by yourself.

        Thanks ITZPrams.
        Why should my L1B be in trouble if my H1B gets approved with COS.
        I'll do leap frog, this way I'll be back on my L1.

        My H1 will be effective come Oct 01 2008. If I travel out before Oct 01 and come back after Oct 01, then I think no problems should come up with my L1.

        The problem will start only if I remain in US after Oct 01 and still work on L1B. This is what I believe.

        Please let me know if I'm wrong.

          You are correct and that is what I had mentioned too
