    hi all,

    i have applied for H1bvisa,and the petition got approved.waiting for the documents from my consultant.At the time of applying,i was working in a reputed IT company in india.since i have to give 2 months notice to my employer,and my consultant in US said that he needs me there by october1,i gave prior notice to my employer and relieved off on SEPTEMBER 8,2008.i have got all the experience letters and relieving orders from the indian company.
    My H1b visa interview is scheduled on 30 september,2008 at chennai consulate.
    my question is:
    1: will it be a problem that im unemployed at the time of interview?(date of resignation is 8thsep,2008 and date of interview is 30thsep 2008)
    2: what should i answer to VO about the resignation?
    3: Is it mandatory that i must be employed at the time of interview?

    I have all the paystubs,relieving order,experience letter,etc.,given by the company where i worked.

    Members and seniors members,please suggest me on this issue.

    I attended the interview on 10th Sept and got the Visa. I was also was in the same position like you. I resigned on may 2nd and for the last 5 months, I was running a training business. Just say you have taken a break to prepare for an important technical certification( if they do ask about !!!). There are only bothered about the genuinity of the employer and the employee.

      First of all i thank u for the prompt reply.

      For ur information,i have an other offer from a small company based in hyderabad.The company asked me to join on 15thseptember.(small company with good package).but i m waiting for the visa interview to be done on 30thseptember.i have not yet started working there. i have the offer letter with me.

      can i inform the visa officer about this offer(in case if the officer asks what if i deny ur visa?)
      or shall i tell the visa officer that i have taken a break and doing some technical certification(as u said).

      moreover can u explain me how ur interview process went through.what are the documents they have asked?since this is my first H1b interview,ur help would be appreciated.

        Even I am in a similar situation. I havent been working since last 10 months due to personal reasons but the company i was with gave me off on unpaid leave. My work experience certificate shows me leaving the org in May 08. After that i havent joined anywhere.

        What did you fill in for present Employer/School ?

        Am really happy to read about this situation which has given me hope.
