H1 to PERM

i am a doctor working for a hospital on an H1 visa as a trainee, i will be graduating Jan 2010, so i have exactly 16 months before my H1 expires (to complete my 6 yrs).
i got a job offer and i want to start applying for PERM and GC but the lawyer is telling me that he cannot apply for PERM based on that job offer because i do not fulfill the criteria of that job RIGHT NOW!!
the problem is that if i wait longer i will probably have to leave the country when i'm done
what do u think i should do

The lawyer is right. If the position requires a MD, you, as a candidate should have that qualification as of the date of filing of the labor.

There is not much you can do right now. You have taken way too long to complete your MD. Check the possibility of J1 for the rest of the period.
