H1 Delayed

    Hello,

    I applied for my H1 this year and it got picked up in the lottery.
    This was sent to the USCIS office at Vermont for processing on May 09.

    1) Till today, 09/15, my H1 status states pending in the USCIS website. Is it normal for them to delay this long ?

    2) What if my H1 does not get approved before Oct 01 2008 ? Also, could you state some reasons for the delay.

    3) My employer sent me the receipt and it shows my employers and my name in it so now I know the receipt is mine.
    Could there be someother loopholes / irregularities that I'm not aware of ?

    Please let me know.

    My Friend also has the same H1 status at Vermont and waiting for final approval so that she can resign from her current L1 sponsoring company ! L1 expires next year but current project is over too

        Which Reciept your employer sent to you? and you case was Approved or still not approved? because when your case will approved then Employer send you I-797B Reciept thats Notis of action. your case is not approved still right.. wait in USCIS process nobody can do anything..

          H1 Renewal

          Hi,

          My H1 is expiring Sep 30, 2008. My company started renewal process in mid August and they say that the documentation reached USCIS by Aug 25, 2008. I did not even receive a Receipt till now.

          Can I stay in US after Sep 30, 2008 without even a Receipt?

          My company also has a case pending with DoL regarding Bench pay. Will this be any problem with my H1 Renewal?

            My H1B is still not approved. It's pending with USCIS.
            I received form I-797C from the employer.

              Receipting should not take so long. Did USCIS cash the check? If so, the back of the check has the receipt number for the case. Ask your employer/lawyer to get it.

              IF DOL case is not resolved as per the law, DOL can block all labor certifications for the company thereby all H1bs against those labor certifications would get messed up.

              You can work on a pending application (240 days) as long as it was delivered to USCIS before the I-94 expired.

              I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

                I got the receipt now. It was dated Aug 29th. Not sure what took so long for my employer to receive it. I asked my employer to push it to premium. He said he alreadyconveyed that to attorney but he is saying there is no way he can give me a document proof for that. Is there any way that i can get to know this information.

                When you say that all H1Bs against those LC's could get messed up, is it while approving the H1 or while going for the stamping at the consulate?

                What if I get to know that my H1 is rejected after Sep30th 2008(the day my current visa expries). Can I apply for a H1 transfer to another company then?
                What will be my other options?

                    It could be either. Cannot say anything about it. No transfer will be allowed after I-94 expiry and H1b rejection as you would not be in any legal status if that happens.
