H1-B - position terminated prior to its start date on October 1st

Hi,

this is my case : my employer-sponsor terminated my upcoming position before its prior start in October 1st.

I already got the H1-B visa in my passport but as far as I know that visa is not valid anymore.

Questions :

1.- Would be the right way to proceed to travel as a tourist to the states, then find a new sponsor and then travel back to my home country in order to get the visa again with the new employer-sponsor?

Do NOT post the same multiple times. You cannot travel using an invalid visa. You run the risk of being sent back from PoE.

I posted twice by mistake, I apologize for it. About your answer, could you be more precise? I am in my home country right now, it is clear the H1 visa I have is not valid so I will have to enter as tourist, then find new sponsor, is that right?

Your visa is still valid but you cannot travel on it unless you have a new employer's approved I797 and offer with you. Travel without a job offer on H1b will not only be fraud but will also lead to serious consequences.

Have a new employer file a petition to transfer the H1b, get that approved, travel on the same visa after that. Read the FAQs!!!
