  • Got 221g from Dubai consulate (Help me!)

    Dear All,
    I attended for Visa Stamping at Dubai Consulate the day before yesterday (23rd September). The officer, first asked me to fax company tax returns from 2005-to-2007. I said to her, I have some other documents which proof company existence and its validity. After that, the officer talked to other person (probably he is officer too), and asked me to give all documents (all my university certificates, working experiences, company letters, company pictures and all I got except my passport) to consulate.

    She said, processing H1B would take longer than interview time and I need to wait. She said, "honestly it would take about a month for us to decide about your application". I completely surprised. She, said I should not do anything but wait and consulate would contact me. I asked would take contact me by phone or email, and she did not even answer ("we will choose ourselves").

    I just want to ask experts in this discussion forum for help, have you seen this kind of behavior from US consulates? And if you do, could someone please tell me what I should expect ? Could I do anything?

    i am also same situation, but i attend qatar us embassy
    i attend interview 24 august the consular lady told me she ll contact me
    after a month spet 24 they called and tolg me come there.
    Then they issure 221(g) white, it states that they r goint to sent my application kentucky consular center.They didnt answer nothing more than this

    any one have idea how long it ll take

      Your situation

      Hey Shabeer,
      Let's talk about our situations. I worry about my employee, my employer in United states is not very big company, is had only 7 employees. The officer asked me about who did paid the fees (employer or me). Could you please let us know your conditions?

        Yes, US consulates are famous for this kind of behavior. And also for making applicants like you go through what you are currently. All you have to do is just patiently wait.

        So what was your answer about who paid for your H1?

          Thanks for your kind and supportive answer. My employer paid almost all fees and I said to officer that all fees paid by my US employer. Then interview went like this:
          * She doubt my answer, and asked how many time you had been interviewed?
          * I said, we have not any interview, and my employer asked me to do some little projects to ensure about my skills.
          * That time two officer was laughing !! (I don't know why). She asked, did he paid you for those projects?
          * I said no. Those were little projects and so employer did not paid me for them.
          * Two officers talked for some seconds, and she asked, did you paid for this 133$?
          * I said, yes. I did. It is VISA fee and I paid it myself.

          After that she said you should wait and we will contact you till one month. She got all my documents and said we should process all these documents.

          Lots of people in this forum got their H1B visa in first place, so, I thought the consulate would not like to give VISA to me. Is it right? Should I wait for good news or bad news?

          I appreciate your help in advance,

            Are you sure you are going for work on H1B?? or are you plan to enter into USA on H1B through some agents?? and yes, you mistaken lots in your interview , you answer is not enough & its unsatisfied to VO. in H1B employer taking atleast 1 or 2interviews to hired you or anybody, and if your employer don't paid you then how can you stay in USA & whats the salary mentioned in LCA , I-129, in offer letter? H1B means you must have to get paid, ohh God but your interview is not Satisfied to VO thats it.. thats all your mistakes wait upto that period which VO already mentioned you. best luck

              Hey OMM,
              Of course the employee will pay me for my work. The problem is I'm Iranian and the US government would not grant a Visitor VISA to us to be interviewed there (For political reasons). So, the only option I got, was working freely for small period of time to approve my skills. I did some small projects for my employer and he accepted to sponsor me for H1B visa. My case accepted in H1 Petition and I had I797, LCA and I129 forms. Employer specified my salary in LCA just as you mentioned. I did not talk to any agent and I know the employer just from internet job advertisements.

              Please consider my answer and let me know if those promising or not. If you think I need to describe my status more and more, may I send or fax some other documents to consulate ? I just don't want to face a reject ...

                most probably they will enuire about your employer
                if they satsfied they will issue visa.otherwise they will send your petition USCIS reconsideration bcoz the employer is very small.in these situation your employer can only help you we can do nothing

                  Thank you very much for help. So, what should I ask from my employer? He is very kind and may be if I ask him, he help me. But I don't know what to ask!

                  Today I talked to some other Iranians got 221g or rejected at all from Dubai consulate. They said, may be my employer could pursue the case from USCIS or DOS. But they weren't sure and I have not any idea too. Please help me if you do the same.

                  I was wondering, if experts in this forum could tell me, could employer help us get out from 221g status at all or not?

                    interview even possible to by phonecall, or some online conferance systems. you don't need to travel USA for it.. I hope you understand well H1B first. without interview how you found job??

                      I appreciate your help, but I can't understand your point by asking these questions!

                      As I said before to you and to VO, and based on what happened in the last year, I did projects for employer to aproove my skills. He wanted a software programmer to do Ruby on Rails development for him, and so, he specified a little and real project for me, he specified a time frame for that project. I did that, he was happy and he sponsored me. That's it. I am not tring to **** anything, lie to VO or you or anybody else, it's totally useless.

                      I'm not agree with you, if interview could be a video conference, it could be a chat session, but most employers want to have face to face interview with employees. It's the reason for indians like you get B1/B2 and fly to USA for interview. We had not any interview session with employer, but we talked more than 100 hours in skype and sent thousonds of emails.

                      I understand H1 myself, and I had two cases in the cap (April 2008). If you understand H1 and you can help, then post me a reply, if you have not; please leave me alone. I read your other posts in this website, I thought you are helpful person.

                      The point I am seeking right now is, how my employer could help me when my case is in administrator processing in consulate. You know something, please post me. Thanks in advance.

                        not always, you are wrong as per interview point, No, not all people travel, I never applied at indian embassy, I applied at S.africa johnesburg consulate. and I never travel before to USA, I faced 2times phone interview upto 20 to 30mints. it's depend on your Experience, qualification , description about your work in CV, Employer's requierments etcc criteria.
                        In india not all people can travell for interview and mostly it's not affordable for somany indians. I hope you understand. but VO if asked about interviews then it's must have to reply about interview. and in this world without interview I think job is not possible , but impossible, if you say like you appeared your interview on phone then this is the 100% valid reason and there is not requiere any documents for that... thanks..

                          I want to realize how my employer could pursue my case through USCIS ? My case is in admin processing and I want to make the process fast.

                            how do you know your case under administer processing ? Have you emailed them yet? Did they tell you that?

                              Your visa is in the hands of the consulate. There is nothing more your employer can do unless the consulate asks for specific employer documents. Be patient. Especially since you are not applying in your home country, it will take time to verify your documents. If you employer is not well known, he must be investigated to make sure that he is not a fraud. Read this forum and see how many people have been hurt by fraud employers. You are better off where you are rather than entering the US with a bad employer.

                              By the way, why do you need to make the processing "fast"? That is very suspicious to me and may be to the consulate as well as you are applying in a very unconventional manner.
