  • L1B to H1B change of status --

    I came to USA in Apr 2007 on L1B status through company X . Company Y applied for my H1 in 2008 quota and picked my name in lottery and also it is
    Consular processing( No fresh I-94 attached
    with H1).
    Now I do not want to join company Y and would
    like to continue with company X till dec 2008.

    If I get an offer from Company Z in Dec 2008, can I ask Company Z to apply for my COS from L1B to H1B directly without joining the company Y.
    If yes , can I ask company Z to transfer my H1
    from Y to without having any pay stubs from Y.
    For this do I need to travel again to india and get
    H1 stamped or just Change of transfer filing here only?

    Your H1 was not approved with COS. So you are fine continuing with X. When ready, ask Z to file for a transfer, no paystubs is fine assuming you have been maintaining L status.
