    Hi All,

    I am working in a big company(A) which has so many divisions.Some divisions got acquiesced by some other company(B) not complete company.I am working under that specific division which got acquired.

    My question is:

    I am on H1-B status visa.I am full time employee for the company A which holds my visa.Do I need to apply for Amended H1-B petition.

    Here my status in the new company (B) is same I mean same location,salary and job but only concern is that I will receive pay stub from company (B) which mentions that I am working for that company.

    So If I am going for a visa stamping for extension Do I need to take any supporting documents Or Do I need to apply for Amended H1-B petition.


    Please let me know ASAP

    It is a complicated section of the law and greatly depends on how the acquisition was handled. If the company took over the immigration stuff of the employees and the employee does the same work, no amendment might be needed.

    In some cases, the new employer may not have assumed the immigration responsibility in the takeover and in such cases a complete H1b transfer might be needed instead of an amendment.

    Your corporate lawyers and HR department know these details the best.
