I had h1 on MS quota in 2005 which was valid till May 2008 for company A. my wife was on h4 which as also expiring in May 2008 with me. I joined new company B in Jan 2008 before my h1 expired. My new employer filed I-129 for me in january 2008 and file 1539 for my wife in february 2008 after one and half month of my filing. We both had seperate case numbers (EAC numbers) for our cases. I after having peding status up to six months i changed my application in to prepmium processing and got my application approved but my wife's case is still pending for last eight months. How long can she stay in usa with pending status??
