  • H1B Extended and applying for H4 without H1B re-stamping

    Hi

    Can i apply for my wife's H4 visa after getting my H1B extension approved
    without having my passport re-stamped with H1B Visa for that extension.

    If yes than do my wife need any other documents except my new I-797(notice of H1B extension) and extended I-94 of my H1B renewal period as proof of my H1B visa validity for next 3 years.

    Am i risking my wife's H4 visa if she won't be having my renewed H1B visa stamping copy while attending interview at consulate? What are the risks associated.

    Hi,

    There are no risk associated as long as you give all the documents to ur wife for H4 stamping as mentioned in the list of immihelp
    For ur question - ur wife does not require ur new stamping in the passport as long as she has ORIGINAL NEW I-797 , Extended I-94 Photocopy , I-129 and LCA .
