  • Is H1B VISA dependent on US MARKET situation?

    Is H1B VISA stamping dependent on US MARKET situation?Does anyone feel that with the Financial Crisis and Job losses in USA , it will effect the ISSUANCE of H1B Visa's as of now.
    Because folks who reach USA on H1B Visa will actually be taking away a JOB of some "unemployed person" in USA.
    What do people in USA say to this?

    While your visa may be issued, if you travel to the US and are unemployed then you will be out of status with potential long term future adverse consequences.

    Even if you have a visa, do not travel if you are not assured of employment. If your employer is a consulting firm without long term contracts, you will regret you decision to travel as too many of these firms do not abide by US law and do not pay their employees. You will find that the cost of living will drain your resources. You do not qualify for any support services - such as food stamps, low income housing, medicaid - as a highly paid guest worker.

    It is only right that US citizens have the first option for jobs for which you and they are qualified. You may work in your home country; they may not. Why would you expect that a foreign national deserves to displace a citizen worker in any country?

      A friend of mine, who actually was my team mate here in US, went recently to Chennai for stamping his H1 renewal... The VO specifically mentioned the financial crisis and told him it will be very difficult to find a job even with his experience (10 yrs), VO mentioned the job situation is going to be worse... Anyway they issued a 221g asking for the usual documents (list of employees, employer client agreement, client letter etc...) Worse just after his consulate interview our client shed most all contractors except a few... His contract got terminated and he is in a difficult situation now , didn't heard any updates from him...

        The consulting companies would have a hard time finding projects for placing fresh H1bs in the current economy. Remember, you have a job and need to get paid all the time on H1b. Having a project or not isn't your headache. It is your employer's job and that is why they get to keep a huge % of your pay.
