H4 to H1 question

I came in US in 2006 on H4-Visa and my H4-Visa is valid till Mid-2009.
In April 2007 , I applied for H1-B visa and it got approved till 2011.
I haven't got out of US after that.

In Jan 2008 , I applied for SSN and got it.

BUT I haven't started working yet.( and not sure if i get it in cpl months)

1. Is it true that untill I start working , H1B will not come into effect
and i can apply for H4 extension in 2009 when it expires.?

2. If I go out of US then I should be able to come back into US , based on H4 VISA?


3. I have understanding that , my employer need to fill out some
form once I get a job and start to work ( since I was on H4- visa earlier)..is that true..?

4. My husbands employer is applying for green card so would there be any difficulty due to my status?

1. No. Your H1b started in Oct 2007 and you have been out of status since then. You are in a very bad position. Consult an attorney.

2. No. If caught, you could be subject to a mandatory 10 year ban. Being out of status and illegal are different things but can be applied accordingly by the IO/VO/CBP.

3. Not true.

4. Definitely for you during the GC when your history is scrutized.
