  • Do I need to go for Visa Stamping ?

    Hi,

I have a question regarding my passport getting stamped with New Visa.

I was working with Company A between 2004 and Aug 2008.

I have valid Visa with Company A till December 2010.

This August I moved to Company B. I have H1-B Approval with Company B.

I am visiting India this December (2008).

The question is, do I need to go for Visa Stamping to re-enter USA ?

Company A canceled my H1-B with their company.

Can I Re-Enter USA if I carry my Passport with Company A Visa and Company B's H1-B Approval form.

    Thanks,
    Gita

I know many people who've travelled without any problems without going for new stamping. Just the Visa stamped from the old employer and the I797 from new employer. So, you can travel.

    BUT

I dont know about this visa cancelling thing. I've learnt that usually companies dont go ahead to report and send cancellation to USCIS. So, since you are saying its "cancelled" your case maybe different since the Immi Officer may get confused with your company coming up as cancelled.

If you arent sure they've cancelled, I am sure you can travel. No problems. But, for cancelled H1 - Please wait for someone else to comment. Goodluck.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
