    Hi,

    I am writing this for my friend. My friend is working for company "A" and got H1 from company "B". It has been more than a year since he got H1. Due to personal reasons, he's not able to come to US and work. Now, he wants to transfer the H1 to his current company "A".

    Also, his L1 visa got expired and his company "A" is sending him to US on L1. Can he go for renewal?

    My questions are:

    1)Is it possible to transfer H1 from India without paystubs?

    2) How can he do L1 renewal without affecting H1

    I read in this forum that one can transfer H1 to another employer without working for original H1 employer and can transfer before employment start date. Is this true.

      My friend is still in India and working for company "A". It has been a year since he got H1 from Company "B". Can he transfer the H1 to company without working for company "B"?

          Let me tell you my friend's case.

          He landed in US on Jan 15th 2008 on Company A's H1b approval & he applied for H1B transfer to company B within first 15 days. According to that Comapny B's lawyer, if you file for H1B Transfer within first 15 days (days count from the day you get your I-94 at airport) then you don't have to produce anything from Company A which is currenlty holding your H1B( not even one pay stub).

          And now my friend is legally working for company B

            Except that it is illegal to enter US with no intention to work for the employer. One should always be prepared to show proof of getting paid on H1b though sometimes USCIS could have been lenient, that is not a norm and should not be taken as a given.

            If one has not been in proper status, it is illegal to work using AC21 portability.

            Remember, any such thing uncovered at a later stage in immigration could count against the person and would void all future approvals from that day.
