  • H1B Transfer - Please Help

I have few queries regarding H1B transfer.

Currently am on L1-Blanket visa working for company A (Till this day).

Meanwhile I have got my H1B approved, sponsored by company B, valid to work on H1B right from 1st October 08. I have not started to work for company B. I am looking out for projects.

I got an offer from company C, willing to transfer my H1B.

    1. Do I need a pay stubs from company B, in order to transfer my H1B. I would not be having it because, i have not started my work for them

    2. Is that Okay, if i submit my latest company A pay stub(but would be under L1 status)

    3. When the H1B transfer is denied, will i be able to continue to work for company B(who sponsored my H1B) without any problems.

Thanks in advance, I really appreciate it.

    Thanks,
    Ram

I assume, since you are in US, your petition was approved with COS. Which means you should have started working with H1B employer from Oct 1st.

Chances are higher to ask for paystubs. In that case you will get RFE

    2. Is that Okay, if i submit my latest company A pay stub(but would be under L1 status)
If you H1B was approved with COS then you are illegally working with L1 employer. What you are asking is impossible.

Yes, you can continue with H1B but if it was COS then you are working illegally with L1 employer.
I am not a lawyer and this is not a legal advice. Use it at your own risk. Consult professionals before getting into an action.
