  • H1B Transfer - Min Wait Time

    Hi Guys - This is for a close friend of mine , who is in USA on H1B with Company A from Oct 1, 2008 with a giant IT consulting firm.He got his first pay stub on Oct 15,2008 and also notified me that he will have the next pay stub on Oct 31,2008.

    Now he is about to get a full time job offer ( not consulting ) with a company B in USA.

    My questions are

    1. How long does one need to wait before intiating H1 transfer ?
    2. Will USCIS raise a query if you try to intiate a H1 transfer in less than 45-60days?
    3. How many pay stubs will be required ?
    4. Is there anything else required to prove his legal status ?

    Appreciate any comments from seniors and friends.

    Let me answer your queries based on my personal case.

    - One can transfer H1B Visa anytime, he/she doesn't have to wait for 45/60 or else days.
    - As long as you've one pay stub, its enough to transfer H1B visa.
    Note: some forum says you need 3 pay stubs atleast, but when I transfer my H1B, new company's lawyer asked only one pay stub which should not be older then 60 days.

    - You should not get any query from USCIS, as there is no law to work with company A for minimuch this many days.

    H1B Transfer premium processing charges 1000$ more but it takes ony 15 days, while normal H1B Transfer processing takes 3 to 4 months. However, you can start working with Company B as and when you get H1B Transfer receipt number.

        Just one more question - If H1B transfer to company B is denied for some reason , can he still work for Company A ?

          Yes, as long as A has not revoked the petition.
