H4 visa with no H1 visa stamping

Hi,
I was on L1 visa, my husband came on L2 and worked and got transferred to H1 visa in 2006. He is working for the same company and has not gone for H1 visa stamping till now. I left my company(L1 canceled) and got H1. When i went to chennai for visa stamping i got 221(g) blue and today i received mail that my visa is refused.

Now i am planning to go on H4, is it okay to attend H4 visa if my husband is not having H1 stamping and he has I-797 and I-94.

please help me.

H1 stamp is not needed for H4 to get the visa. Just the approval notice I797A for H1b is good.
