  • Which I-797 info to use for H4 visa interview

    Hi guys,

    Just a quick question.

    My current I-797 expires on 28th Dec 2008. I got the new I-797 which expires on 28th Dec 2011.

    My wife's H4 visa interview is scheduled for 5th Dec 2008.

    In the 'Petition Details from Form I-797', which Receipt number and expiration date could I write? The receipt number and expiration date from the I-797 which expires on 28th Dec 2008 or that from the I-797 which expires on 28th Dec 2011?

      Just to clarify, the I-797 which is valid, when my wife goes for visa interview is the old I-797. (My wife's vis interview is on 5th Dec 2008).

      Logically, shouldn't we use that old I-797 info then?

          Submit both. You will get the visa till 2011. Write 2011 date on all forms.

            Thanks for the reply.

            I can fill only one I-797 Receipt Number when I am filling the petition details online.

            Which Receipt Number can I fill here? The Receipt Number from old I-797 or that from new I-797. Thanks.

              Please use your judgment. The new one has an expiration date of 2011. You would obviously go with that.
