  • H1B Profit Organization to H1B Non Profit Organization

    Hi Friends – I am posting this on behalf of a friend of mine. Here are the case details

    o Currently employed with Employer A (IT consulting and staffing firm) on H1B status ( application was filed on April 1 , 2008 )
    o Employer A is profit organization
    o Candidate entered USA on H1B visa on November 7 ,2008 with a client project in hand
    o Candidate is not out of status and has his first pay cheque so far
    o Candidate has got a better lucrative and exciting offer with Employer B who is nonprofit organization ( IT Healthcare company )


    Here are the questions that needs expert feedback

    o Is it possible to transfer a H1B from profit organization to nonprofit organization?
    o If yes what is the procedure , documents and cost involved? Is this procedure cap exempt?
    o If the candidate wants to come back on H1B status with a profit organization in the future is he cap exempt since he already hold a H1B status with a profit organization which was counted against the cap ( employer A ) ?

      Possible. Once cap counted, it is possible to switch back and forth between cap and non-cap employers. Procedure is no different than a regular H1b transfer.
