  • H-1 extension

    I'm on my 6th year of H-1 with employer A and a PERM application was filed by employer B before the end of my 5th year of H-1. However, I donot start employment with employer B till my 8th year of H-1. Can employer A file for my H-1 extension for year 7.
    Any thoughts

      Thanks for your reply. Do I have to wait 365 days after the PERM application has been filed to apply for H-1 extension or can I apply even before that as my current H-1 expires June 30, 2009. (Date PERM filed was July 15- I have 42 days to recapture)

        As long as it was filed prior to the 365 days of H1b expiration, you can file for extension.
