  • H1 Transfer - Old employer clause

    Hi

    I am transfering H1 from company A which is currently holding my H1 to another company B which is sponsoring my H1. At the time of joining A, there is a clause in the offer letter saying that I could not working for the same client for 1 year without that company . Will it be a problem if i transfer my H1 and is it possible for my employer to make it an issue.. Please let me know..

    If you have singed on such documents then employer may raise an issue.

      Basically, you're ...

      ... working for the same client through another consulting company.

      In other words you're cheating your primary consulting company.

      If you have a document signed with them, they will not only make it a big issue for you and put you in deep trouble, but they will also report/complain to your client which will probably cause your client to let you go, whether they like it or not.

      In many cases, even if you have not signed any such document, still your employer can cause the above mentioned serious problems for you.
