I am in the following situation.
I have been living in the US on a H-1B visa for the past 4 years. That visa is expiring in February but due to a family emergency I have been in London for the last 4 months and my lawyer advised me not to apply for a visa extension while I was outside of the US.
Now I am ready to go back to live in the US.
Will I have any problems entering the US on a H-1B that is expiring in about 4 weeks?
If not I presume that I will get an I-94 with a date in February. If I file for a visa extension as soon as I get back into the US will I be ok to stay beyond the date on the I-94?
Any advice would be really appreciated as I'm planning to fly out in the next few days.
