  • Urgent Help for H1 Extension

    Hi,

    Here is my case,

    My Extended I-797 was expiring on Jan-10-2009 Along with I-94 on Petition.
    Some how things got messed up & my Employer finally send the extension on Jan-09-2009 (friday) for second day fedex delivery to USCIS which was saturday.

    This is my 5th year on H1B.

    My Visa & last port of entry I-94 was expired on Sep-15-2007.

    My H1B was extended till Jan-10-2009.

    Can my extension be denied becuase it was filed on last day?

    Another thing my GC is under process & PERM,I-140 is approved.

    Will this create any issues at 485 stage.

    Your Helps are really appreciated.

    My Family & I am going through sleepless nights.

    Most likely it will be denied as your I-94 would have expired.

    You could however work on EAD and remain as a parolee if you have a 485 pending. POE I-94 date does not matter if you got an extension approved with the same I-94# and a new expiration date.

        Please any help on this

        Fedex try to deliver my package on Saturday 10th Jan but future delivery requested & finally it was delivered on Monday Jan12th.

        am i out of status for 2 Days?

        will this impact on my approval?

        will USCIS consider monday since 10th was my last day but it was saturday?

        Any help is highly appreciated.

          You are illegal when the application reached USCIS. Your H1b extension will not happen.
