  • Help in Visa re-stamping.....!!!

    Hello all,
Sorry for writing big message here....pls help me....!!!
    Here is my situation.

Came to USA in July07 throug my fist company A on H1B.
Transferred my H1B to company B in June08.
But due to some reason that project didnt kicked off and I was forced to be on bench without any pay. The company B didnt help me out in finding another project and kept saying that he will not start paying untill he get me into a project. He didnt generated my paystub also.
On my own effort I found another good job with company C and transferred my H1B to this company C in Aug08. Since then I working with this company and getting my salary and paystub.

I have been sending so many mails/calls to Company B for I797 and paystub but not getting any response...!!!

Now due to personal reason I am going to India in Feb on vacation and need to go for Visa re-stamping in Delhi.
In form DS-157 in question-12, it asks for the complete details of last 2 employers.

My question is apart from giving details of my employement with company A, do I need to give the details of Company B also ? If yes then

I dont have I-797 and any paystub from company B (I was with this company B from June08 1st week to Aug08 last week).
WIll it be a problem in Visa restamping due to this reason ?

And if I dont mention about this employer in my DS-157, will the VO at consulate come to know that I have tranferred my H1B to this employer B as well and have not written on DS 156 form ??

    Seniors pls help me out....!!!
I would really appreciate your suggestion.

    Thanks

No lying on visa application. It could ban you forever. Complain to DOL on a WH4 form along with proof and they will make employer B pay.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
