  • Switching back to H1 from EAD

Hi. Currently, I am working on EAD through my husband's employment. Our I-485 was filed in Sep 2007 and in pending status. We are planning to file for divorce.
I switched to EAD from H1 in Nov 2007 and My H1 has validity till March 2010.
Question: Is it possible for me to switch back to the same H1 to bypass the quota hassle in case of applying for new H1? Can I get it transfer to my current employer or to some other employer?

You can ask your current employer to file for H1b. You are not subject to cap.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
