I filed for my H1-B through a consultant in 2008 and got it approved. However, I have been on bench since October 2008 and will not receive any W2 from the consultant because I have not been paid since October 2008. I plan to get my H1-B stamped and need to know if this will cause me any problems?

---- Yes, you need to get paid and also have a W@ forsm. Regarding the pay complain to DOl and regarding W2 form complain to IRS. that will get the employer do the needful. During samping you need to show some evidence of this when asked, else you are a potential 221g case
