I'm working with an Oil major after my PhD. My OPT (obtained on F1) is set to expire in mid-May. My company will file my H1B application for this year, and the law-firm hired by the company tells me that they will try O-1 late April if H1B doesn't go through. If I understand correctly, the O-1 approval process can take more than 2 months. Therefore, there will be some time in between when I will not be able to work, I guess. My question is, if I were to avoid this by filing for O-1 right now and then also file an H1B petition, is that okay? Or this is likely to cause a problem with H1B if O-1 application is pending?
