  • does "filing" = "mailing"?

    I work for Employer-A as H-1B.
    USCIS says: "nonimmigrant may begin working for NEW H-1B employer as soon as new employer FILES a H-1B petition".

    QUESTION: is it LEGAL to begin working for Employer-B on the SAME day Employer-B CERTIFIED-MAILS a H-1B petition?
    If not, how soon?

    It is legal to work the day USCIS receives the petition.

      but, what if the USCIS denies the petition and the current employer A cancels the H1?
      The person will be in a big problem.
