    Hi
My H1 is expiring on March 31st 2009. I hv been laid off and 28th feb is my last pay stub day. It will take some time before my company revokes it.
If I am planning to change to B1, is that a good option?

If i don't get my H1 transferred and let it expire, do I have to go thru the cap when I apply for an H1 again?

Also, I still have 3 years left on it. So will I be granted those 3 years on my new H1 without going thru the cap?

If yes, what is the latest I should be applying for the new H1 so I don't have to go thru the cap i.e what is the maximum time period allowed between the expiration and new application for the non cap H1.

    thanks
