    Hello TxH1B,

    This is with reference to one of the queries in this forum about COS.
    Can an employee take legal action against an employer who files a COS without asking the employee ?

    There are many posts that say that COS was done without their knowledge and later when the petition is approved and if an employee is not ready to work for the H1 employer, he gains illegal status. Thus jeopardizing the immigration record.

    Please let us know.

    No you cannot sue. You provided a copy of your I-94 thus conceding consent to file for a COS. Do you have documentation (atleast an email) showing you requested CP and not COS??

    People just provide all documentation asked for without knowledge and crib later because of unfavorable circumstances

      H1b is employer's petition. If you want to avoid COS, do not provide I-94 copy.
