H1b and B1

  • H1b and B1

    Hi all,

    I got my B1 stamped from employer A in India for 1 year and same year got H1b Approval from other Us employer and stamped the same.
    But till now i did not go to USA neither on H1b nor on B1 and i am with the same employer A in india.
    Now my employer A wants me to reapply for B1.
    if i go for the B1 Stamping again, would it make any effect on my H1b Status.
    Is there any case of cancellation of H1b.

    Please suggest ASAP.

    H1b and B1 visas can remain on the passport at the same time.

      I also searched on net for the same info and one said:

      A consular officer could potentially, at the time of the B1 interview, determine that you no longer can demonstrate that you meet the requirements for holding H1B status and cancel the visa.Mine is same case. They have cancelled my H1, that means they will put a rubber stamp across the visa "Cancelled without prejudice" and gave me business visa.

      is this case possible?

        Possible depending on the VO. If your H1b petition is still valid and your job offer still is good in US, you can tell the VO that you plan on using the H1b at a later date. There is no rule that the visa needs to be cancelled.
