Does the previous H1B approval required for filing new H1B application?

I have H1B approval from company A. I am married and my husband is in US on H1B. I have joined my husband on h4 visa on vacation. My company is neither getting me project here in US nor providing me I797. Does I797 is required for filing any new H1B applications?

If you have a copy of previously approved petition, you can join a new employer without going through cap/quota again. If you have a case #, an online printout will also do it for you.

If you are applying under a new 2010 cap, you don't need the previous I797.
