L2 and H1 Amendment

Hi,

I have a clarification on my husband visa status.

My husband came in to US in Sep'08 on L2 Visa.

Since he had a valid H1 Petition after coming here his employer did a premium process and Amended H1 to L2.

H1 is not yet stamped.

1 . Now if he leaves to India and if he wants to come on L2 is that possible.

2. what will happen to his H1 if he comes on L2.

Please clarify.

2. It will be valid petition as long as the employer does not cancel it and still has job available.
