  • H1 to H4 COS Question

    Hi All,

    My wife is currently on an H1B VISA which is valid till Sep 2010 and has paystubs till date. She is planning to change her status to H4 as my dependent. My H1B is valid till July 2009 and its extension is underway. I would like to get your thoughts on the following questions:

    1) How long ,on an average, does it take to get H1 to H4 COS approved?
    2) Will she get any document from USCIS confirming the COS ?
    3) As my H1 extention is in progress, will that affect her COS in any way?
    4) In case her petition is pending beyond July 2009, will she become out of status since her H4 is not going along with my H1 extension?

    1. 2-6 months
    2. Yes. You will get a receipt initially and an approval notice once approved.
    3. You could have applied for her COS with your H1b extension and it would have been simpler. No, it will not. Include your H1b extension receipt along with her COS request.
    4.No. As long as she has a COS request pending before her H1 status expires and you are maintaining H1b status, it will not impact.
