  • change of surname

    Hi,

My husband gonna apply for his green card by this week (for me as well), however, I haven't changed my surname in the indian passport.

Should my surname on passport be changed before applying for green card or can it be modified in the mid of the green card processing?

Also, should my husband's passport have my name on it before applying for green card? Or, is it optional for him to have my name on the passport.

Note: I'm on H4 visa (dependent on my husband).

Thanks in advance for the time and consideration to answer my queries.

    Regards,
    Suguna Karthik

You can apply with your maiden name and there will be no issues. To reduce complications, do not change any names once you have started immigration process like applying for a visa. It will just complicate things unnecessarily. It is perfectly alright to go with your maiden name.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
