GC processing while working In India office of employer

Hi,
I have the following questions:

1) Is there any issues/problems with GC processing happening in US while employee is working in India office of the same company and getting paid Indian salary? Are there any legal/tax hassles for the employer or employee? How long can the employee stay out of US?

2) My 6-year H1B expires in Jan 2010. During this 6 year, i have been out of US for almost 3 months on vacations. Does that mean that my effective h1b expiry is Apr 2010 if i recapture that time out of US?

GC is for future employment and does not require one to be in US. Time outside US Can be recaptured.

It can only be CP and not AOS.
