  • Social Security Tax not paid from sep 2007

    Hi,

    One of my cousin holding H1B since 2007,unfortunately her employer didnt pay attention on Social Security Tax from sep 2007 to till date he didnt pay the SS Tax.

    So my question is what will be the immediate step we need to take so that my cousin will be in safe side.

    Please suggets us.

    I am thinking your employer is avoiding their share of the taxes by doing so. Are you on W2 or 1099 being paid as a independent contractor?

    In case of 1099, at the end of the year you will not only be responsible for paying your Federal Income tax, but also your Social Security taxes as well. If you are, you will receive a 1099 form and this will tell you how much you have been paid for the year. If you are on a visa like H1b, it is illegal to work as an independent contractor. The employer should be deducting Social Security and matching the amount also from their side. At the end of the year as an employee you should receive a W-2 form as a record of the amounts withheld from your pay by such an employer.

    Talk to SSA.
