H4 Stamping while H1 transfer in process

Hello Seniors,

Please give me your advice on my below case.

Came to US on L1 and spouse on L2. Got H1B approval and moved to company B oct 2008 and company C applied for H1B/H4 transfer in Jan 2009. After that(feb 2009) my family had to travel to india on an emergency. Now my family wanted to come back. All she had is old L2 stamping and first H4 approval notice which is valid till 2011. My question is,

1. Can she go to chennai consulate and get H4 stamped using her first H4 approval notice by showing my H1 approval notice with company B?

2. If not, what is the work around? Since my kid fell into illness, my family wanted to come back ASAP. Fortunately my kid born in US and has US passport.

You advices are much appreciated.

She could explain the emergency and use the prior companies papers to the VO. In general, your papers of H1b for the company that you currently work for are needed to appear for a visa. The VO may choose to put a hold on it or give a 221g.

You can PP your case with C by paying $1000 and have them appear with your current papers..
