  • I-94

I am Indian citizen on an H1-B visa, currently residing in Massachusetts. I am writing to you regarding a question I have about my upcoming visit to India.

I recently shifted jobs from Texas Instruments to Analog Devices and had my H1-B visa transferred. The visa stamp on my passport is valid until September 24th 2009 and my I-94 is valid until Oct 4th 2009. I am planning on a 1 week visit to my home in India in the month of May.

I am unclear whether I need to visit the consulate in India when I travel there in May to get a fresh H1-B stamp indicating a change in my employer. Could I re-enter the US with the approved I-797A ( which is valid from 11/21/2008 to 09/10/2011) form from my new employer (Analog Devices) and the original H1B visa stamp (with Texas Instruments). Since this visit period is going to be short, I would prefer not to go to the consulate if I have this option.

Kindly advise me on my situation.
