Hi,
I filed my H1-b petition in July 2008. My H1-b expired on Sept 2008. Its been almost 8-9 months, but before 2-3 weeks my employer got an RFE on my case asking for Vendor's Contract & Client Letter.
My question is, what happens after 240 days, which is May 30th in my case, if the case is still pending. Am i out of status ? Do i have to go back to my home country ? or can i work here until my petition is pending?
Also, if the RFE is replied and still the case is pending, in this scenario Can I legally stay and work in this country?
My final question is, if I get rejection, what are my options?
- Can I appeal for the denial?
- Can I go for H1 Transfer?
- Can I go for new H1?
Also, If either of these scenario applies to me, Can I still stay & work in this country?
