Startup filing for H1B- Please advise

I've a small start up LLC with $50K turnover, I'd like to sponsor my brother for H1B for FY 2010, he has MS ( from Australia) and 4 years of Indian IT experience.
Please advise if I can sponsor him, the list of important documents that I should take care of (in case of any query/audit) and the risks involved.
