I-94 on H4 Visa

Hi, Can anyone please help me with this?

I am on H1B and petition expires next year. My son came to US recently after vacation. His pasport expires in Nov 2009 and he has H4 VISA until Sept 2009. So at th POE, I-94 was given until Sept 2009. Will there be a problem, if he stays beyond Sept 2009. How can I apply for extension of I-94?

Of course it is a problem if he stays past the I-94 expiry date. Get the passport renewed and apply for extension of the I-94 using form I539.
