can I go to previous employer on only I797 + I94 issue ?

Hello

I have two I797, one from Employer A & second from B. Visa Stamping on passport & I94 was done for Employer B. Now I M in USA but Employer B can't provide Job so I approach Employer A in USA on base of only I797 (since H1b is valid & not revoke). Employer A says I have to show pay stubs from Employer B & 320$ to amend H1 or go back to home country & do visa stamping & I94 for Employer A. So what to do ? Please help.

Employer A is clueless about what they are saying. You are out of status now for not getting paid. B should pay you from day 1. That is the law. You don't need a new stamp. However, as you are out of status, travel and return to work for A may be needed. Be prepared to prove that you were getting paid and maintained status at POE if asked.
