I797 valid till May'10, Visa expires Sep'09, travelling in Aug

Hi,

Our I797 and I-94 are valid till May'10, Visa expires Sep'09. My wife plans to travel to India in Aug'09 for a few weeks. She plans to be back before end of Aug. With only 1 month left in the Visa does she need a new stamping?

Any rseponse will be appreciated.

No. She can carry the extended I797 and get I-94 till the date of I797 upon re-entry.

It is a good idea to get it stamped as you will face problems of transit visa in the future if you want to travel again through EU countries.
