My wife and kids are planning to visit india in this summer . My visa has been expired ( H1) . I am working in US on H1B papers ( extension ) .
My questions
1. For H4 to get visa stamped over in India , Is it mandatory for primary applicant ( H1B - my self ) needs to be on valid visa ? Or can they get it done based on my Extension papers ?
If yes , Is it any recent change in rule? I have a friend who is same as my case but their H4 got stamped based on his extension INS papers. this is in way back 2007 .
I did spoke with some of my friends... Some are saying that primary applicant's visa should be valid at the time of H4 visa re-entry stamping .. Some are saying it is not required . This is confusing ..
