H1B visa validity without Payroll

My employer giving me Trasfer to India or Termination options. In both the case he will not indicate INS and will not withdraw my H1 visa.

If I opt for Termination option, how long I can stay in US on my own.
Is that any risk involved with out job.
If I get job and can I go to the same employer.
Being jobless and no payroll affect my GC process (I-140 approved).

---- Yes, of course. No job no status in the US

---- Will the employer provide a job and pay you

---- Yes, your status becomes illegal unless you have applied for AOS by filing I-485 and have a valid EAD with you
