  • Confusion about COS. Urgent!!!

    Hi
    My I94 and 1797 from previous employer expired on 31st march. New company filed for H1 transfer on 30th march.
    New company got RFE on my H1 transfer. In the meanwhile, I got an I20 for MBA porgram.
    I am not interested in answering the RFE and want to go to school.
    Is it possible to file a change of status to F1. I have gotten two opinions from two different lawyers.
    One says its not possible while the other says that COS is possible.
    I want a third opinion. The lawyer who said its not possible says that after my I94 expired on 31st march, I dont have a status, i am on the bridging status till H1 is approved and therefore without a current status I cant file for COS. Is this true? I dont know which opinion to trust here.

    Search and read about bridging on the forum. You are currently *not* in status if the bridging petition gets denied. So, a COS is not possible.

      You have to leave and apply for an F1 visa and enter using that visa.
