Reentering US -Passport validity requirement

I am in H1B. I am planning for a visit to india in may 2009. My passport expires in oct 2009.

Would there be any problem in my visiting India and coming back in may2009.

Is there any requirement that the passport be valid at least for the next 6 months from the boarding date in India.

Please help me with this.

According to India-US treaty 6 months validity is not required for Indian passports but your I-94 will only be until passport validity, so you will need to renew passport and I-94 immediately after returning. Read corresponding pages from CBP website and take a printout with you in case the inspection officer is not aware of this.
