  • H1B and H4 filed within a gap of 14 days

I am on h1b and recently joined another company and they applied for my H1b tranfer along with H4 for my dependents on Apr 14, 2009. My wife's H1B was also filed on April 1st, 2009. I want to know that if my wife's H1B is approved before and she receives her H4 later, would that override her new H1B status?

Not if the H4 gets approved before Oct 1st as H1b is approved with a future date of Oct 1st which is the effective date for last action. If H4 gets approved after Oct 1st, it will override the H1b approval.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
