  • H1B(Ammendment) - I-94 Denial - Help Need Urgently

    Hi,

    I came to US with L1B Visa through Company A.
    I have applied for my H1B Visa through Company B last year.
    I got approval for Change of Status from L1B to H1B by end of August.
    I travelled to india twice (Sept and Nov) using my L1B and returned back with my L1B Visa.

    I joined Company B with my H1B Visa in Jan 2009.
    Company B had applied for I-129 to apply for ammendment to get new I-94 due to my travel to India in Nov using L1B.

    My I-129 got denied and still waiting from USICS to get the denial notice to know details.

    What are my option left to me?
    Do i have to go back to India?
    Is there a way i can apply from US for new I-94 again?
    Is my H1B petition got rejected too?
    Should i have to go out of country to get visa stamping and come back again?

    Please let me know what can be done from my side.
    Please do help in responding to this queries.

    You cannot join company B while your COS is pending as per the rules. You have been illegally working for B if you did that.

      But my COS has already got approved in august right. Now i have applied only to get a new I-94 due to my travel to india in november.

      Can you let me know the option left with me ?

        As you entered again on L1, Your COS was invalid. You are not supposed to work on a pending COS on a future status that has not been approved. You have been illegally working. Talk to an immigration lawyer and leave ASAP to not accumulate more illegal stay.
